TERMS OF SALE, REFUND & CANCELLATION POLICY

Thank you for choosing Tawaplatter. This website (tawaplatter.com) and the TawaPlatter brand are owned and operated by Tawaplatter LLC. Because our artisan vegetarian dishes are custom-prepared fresh to order within a licensed commercial cloud kitchen facility in San Jose, California, we enforce a strict policy regarding sales, cancellations, and refunds to preserve strict food safety standards and manage inventory logistics.
By completing a purchase on our Site, you acknowledge that you have read, understood, and contractually agree to the terms below.
1. Perishable Goods; All Sales Final
In accordance with California health regulations governing fresh, perishable food products, all sales are final. We cannot accept physical returns, exchanges, or menu substitutions once an order has been finalized and production has commenced.
2. Strict 24-Hour Cancellation and Modification Window
TawaPlatter operates on a strict pre-order schedule.
- Permissible Cancellations: You may cancel or modify your scheduled Monday, Wednesday, or Friday order up to exactly 24 hours prior to the start of the delivery/pickup window for that day. Permissible cancellations will receive a full refund to the original payment method via Square.
- Late Cancellations: Cancellations or modifications requested less than 24 hours before the scheduled delivery or pickup date are completely non-refundable and non-creditable. At this stage, fresh ingredients have already been dedicated and prepared.
3. Delivery and Pickup Responsibilities; Missed Windows
- Cloud Kitchen Pickup: If you select the pickup option at our San Jose cloud kitchen, you must collect your order within the designated timeframe. If you fail to do so, the food will be discarded for health and safety compliance, and no refund or credit will be granted.
- Delivery Disclaimer: It is the customer’s sole responsibility to provide an accurate delivery address, gate codes, and instructions, and to ensure a person is available to receive the delivery.
- Leaving Food Unattended: If you instruct us to leave food at your door, gate, or concierge, TawaPlatter accepts zero liability for subsequent theft, tampering, pest damage, or temperature-driven spoilage. No refunds will be provided for missed, delayed, or unattended deliveries resulting from customer unavailability or omission.
4. Food Allergy, Dietary, and California Proposition 65 Disclaimers
- Allergen Cross-Contamination: While specific allergens are noted on individual menu items, all TawaPlatter meals are prepared in a shared commercial cloud kitchen environment that processes milk, eggs, wheat, soy, peanuts, and tree nuts. We cannot guarantee a 100% allergen-free environment.
- California Proposition 65 Warning: Chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm may be present in certain foods or packaging materials, or may result from cooking processes. By purchasing, you acknowledge this warning and voluntarily assume all risks.
- No Allergen Refunds: Refunds will not be granted due to a customer’s failure to read ingredient notes or for assumed cross-contamination in our shared kitchen facility.
5. Claims for Order Inaccuracies or Structural Defects
If we commit a verified error (e.g., completely omitted items or incorrect dish delivery), you must contact us at social@tawaplatter.com/+1-209-319-8980 within two (2) hours of the recorded delivery or pickup timestamp.
- Photographic Proof Required: You must provide clear photographic evidence of the incorrect item and the delivery packaging.
- Sole Remedy: At our sole discretion, verified errors will be remedied exclusively via a partial/full Square refund or credit towards a future menu rotation.
6. Waiving of Chargeback Rights
By checking the agreement box at checkout, you contractually agree not to initiate a credit card dispute or chargeback with your banking institution for any issues regarding late cancellations, missed deliveries, uncollected pickups, or personal taste/ingredient preferences. All disputes must be handled directly through TawaPlatter’s customer service.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, TAWAPLATTER’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF AN ORDER—WHETHER IN CONTRACT, TORT, OR PRODUCT LIABILITY—SHALL BE STRICTLY LIMITED TO THE EXACT DOLLAR AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THAT SPECIFIC ORDER.
